General Terms of Service
✮ Please have a reference available for me to work from
⤷ this may be a reference sheet, Photomontage and or a Pinterest board if you are looking for me to design your character.✮You will credit me where it is applicable ( Posts, Social bio, Credits panel etc. For the work I have done✧ Extra! If your OC has Markings/Tattoos please provide a PNG reference in the Upload section found in the form!⚠ Personal / Commercial Use (Free) ⚠
✮ Streaming, Posting, YouTube Videos PNGs or Thumbnail, ect.⚠ Merch Use (Paid) ⚠
✮ Merch Items such as Stickers, Pins, Clothes, ect
✮ Reselling✧⚠ Do’s and Dont’s ⚠✧
✮ I will DO Females mainly/ Animal Features (ears ⊹ tails) SFW and Suggestive (NSFW you will have to ask)
✮ I will NOT DO Heavy armour/ Men ( I cannot get their likeness but we can discuss) Gore / Furry / Mecha / Fetish art
⚠ Anything else that makes me uncomfortable I will not do. ⚠PAYMENTS✧ If there is any confusion with payment such as the prices and or issues with payment please contact me at any point throughout the process! ✧⚠ Please ensure you have full ownership of the funds you are sending! ⚠♡ PAYMENT PLANS ♡
✮ Payment plans will be mainly for Vtuber models and larger commissions nothing under $150-$200✮ There are 2-3 payment plan options. To begin work on each milestone of the commission meaning the initial payment confirms that we will be working together and I can begin drafting up a WIP and or brainstorm ideas. Once the halfway mark of the payment threshold is needed I will move onto the next phase of the commission, Finally once the entire payment is completed I will deliver the final product.✮ I am usually in no rush to receive payment so you can take your time making the payments✮ If there are any issues with payment I wont stop production because of it unless you believe that the commission should be postponed until further notice.♡ Option 1 ♡
1. First payment confirms the commission and allows me to start working
2. Second payment allows me to move onto the next phase in the process which may be rigging
3. Final payment allows me to deliver the final product♡ Option 2 ♡
1. The first payment confirms your commission and allows me to move onto the second phase as this is a bulk payment

This allows me to deliver the final product to youREVISIONS✮ I will be giving updates throughout the process, you can say as many changes as you would like during the WIP / brainstorming phase along with that I am open to feedback throughout the whole process as your satisfaction with the product is my priority. However, don't try to change my art style.✮ If I have sent an update and I finish working on the commission before you answer back I will not be changing the entire result so please ensure you respond in a timely manner, I won’t be unreasonable with when I would like to have your reply.✮ I want you to be happy with the result of my work so let me know about any and all adjustments, even the small details that I may have missed in the final product!DEADLINES AND DELIVERY✮ I have set the Guaranteed Delivery to 4-5 months however if you select No Deadline you may receive your commission before that Guaranteed Delivery date.
⤷ I just do not enjoy the stress as well as the pressure that deadlines give me.✮ I do not offer rush commissions but we can discuss options for you and there may be a fee.✮ You may ask for an estimated time frame for when work will be completed, but please do not rush me.USE✮ You cannot re-sell the artwork✮ I may use this work in my portfolio , resume and or for advertisement needs✮ I may also post updates/ WIPs to my social media. If you would like this commission to stay private please inform me beforehand.✮ No artwork is allowed to be utilized to fund or support Artificial Intelligent databases, for NFTs or other crypto-currency.✮ Do not make changes to my artwork without informing me as it is disrespectful, I will happily make adjustments for you during the commission process.✮ Unless stated otherwise, the commission is for personal use only meaning for Streaming/ReferencingINTELLECTUAL PROPERTY RIGHTSI, the artist, retain all rights to the commissioned artwork. You are purchasing usage rights, not ownership of the artwork itself.✧ Prohibition of AI Use ✧
You are strictly prohibited from uploading, inputting, training, or otherwise using the commissioned artwork, in whole or in part, in any artificial intelligence (AI) system, dataset, generator, or related technology. This includes; creating videos/animations of the Commissioned Art since you have to Upload the Artwork to an Ai.✧ Copyright Ownership ✧
All copyright and intellectual property rights for the artwork remain solely with the Artist (Me, Luminexscence.) Payment for a commission does not transfer or assign copyright ownership.
Paying for the commission only gives the buyer a license to use the finished artwork. It does not transfer ownership or copyright.✧ License of Use ✧
The Client may use the commissioned artwork only for personal or agreed purposes. They cannot copy, sell, edit, or claim it as their own.✧ To Summarise ✧
✮ I still own the artwork.✮ The client is just renting the right to use it (like posting it online, using it as a profile picture, etc), depending on what you paid for that I allowed.✮ The client cannot claim it as their own, sell it, edit it (unless given permission), or feed it to AI.REFUNDS✮ Refunds are given either fully or partially depending on the amount of work that has been done.
⤷ This is because I still put my time and effort into the commission and you have a reserved commission spot that could of gone to another paying client.✮ Even if the commission is unfinished and not to your satisfaction you will be refunded back what is fair.✮ If there is a refund issued after the commission is complete ( Partial or Full ) and I have delivered your commission I do request that you do not leave a review, this is due to the fact that the transaction has been mutually resolved.✧ If I cancel ✧
✮ I have the rights to cancel a commission at anytime without having to provide an explanation✮ I have the right to use WIPs on my socials and as showcases

✮ You lose the right to use, post and or keep any part of the artwork (WIP pictures / videos )✧ To Summarise ✧
⚠ Before work begins a full refund is fair⚠ If work has started a partial refund will be given depending on how much work has been done.⚠ If the artwork has been finished or almost to completion no refund is required⚠ No refund will be required at all after delivery.⚠ ! Terms of refunds
I can refund 100% of the payment only if I have not started working on the sketch after three months.
Once I start the sketch there will be NO REFUNDS.
If I cancel a project, I will reimburse the lost fees and refund 100%.
